  二、国家干预的力度不同。

  劳动合同的建立虽然也体现了当事人的合意性,但它更强调国家意志的主体地位。为了规范劳动合同双方的权利和义务,国家的干预贯穿于劳动合同履行的始终。而在雇佣合同中,主体双方是完全平等的 ,在合同的签订、变更、解除的过程中以当事人的意思表示为主,国家基本不做干预。

  三、争议的处理方式不同。
